By accessing or using www.viandiamonds.com (the “Site”), you acknowledge that you have read, understood, and agree to be bound by the following Terms.

If you do not agree, we respectfully ask that you discontinue use of the Site.

1. The Maison & Its Intellectual Property

All content presented on this Site - including jewelry designs, bespoke creations, craftsmanship techniques, product imagery, photography, text, graphics, logos, trademarks, service marks, and overall aesthetic presentation - is the exclusive property of Vian Diamonds or its licensors.

These elements are protected under applicable intellectual property and trade dress laws worldwide.

No portion of the Site may be reproduced, copied, modified, distributed, transmitted, displayed, or otherwise exploited without prior written consent from Vian Diamonds.

All custom and original jewelry designs remain the sole and exclusive property of Vian Diamonds.

2. Use of the Site

You are granted a limited, revocable, non-transferable right to access the Site for personal and non-commercial purposes only.

You may not:

  • Use automated systems (including scraping, AI extraction, or data mining tools)

  • Interfere with the Site’s operation or security

  • Frame, mirror, or replicate Site content

  • Use our designs for commercial inspiration, duplication, or resale

Unauthorized use may result in immediate termination of access and legal action where appropriate.


3. Orders & Availability

All orders are subject to acceptance and availability.

Submission of an order does not constitute acceptance. Vian Diamonds reserves the right, at its sole discretion, to:

  • Decline or cancel any order

  • Limit quantities

  • Refuse service

  • Rescind acceptance if inventory becomes unavailable

In the event of cancellation, your sole remedy shall be a refund of the amount paid.

4. Pricing & Market Sensitivity

Due to the inherent volatility of precious metal and diamond markets, all prices are subject to change without notice.

While we strive for accuracy, typographical or system errors may occur. Vian Diamonds reserves the right to correct such errors and to cancel orders arising from inaccuracies.

Promotional pricing may not be combined unless expressly stated.

5. Product Presentation

Jewelry imagery is provided for illustrative purposes.

Variations may occur due to:

  • Screen calibration

  • Lighting conditions

  • Natural characteristics of diamonds and gemstones

Carat weights may vary within industry-accepted tolerances (±0.05ct). Natural inclusions and color nuances are inherent and do not constitute defects.

6. Payment & Verification

By submitting payment information, you authorize Vian Diamonds to charge the selected method of payment.

For high-value transactions, we reserve the right to:

  • Conduct identity verification

  • Request additional documentation

  • Delay shipment pending fraud review

We reserve the right to recover administrative and legal costs associated with improper chargebacks.

7. Shipping & Transfer of Risk

All shipments are fully insured until confirmed delivery and signature at the address provided.

Risk of loss transfers upon confirmed delivery.

8. Returns & Certification

Eligible returns are governed by our Return Policy.

For diamond purchases accompanied by grading reports, the original certificate must be returned. Failure to include the grading report will result in a replacement fee of $500.

Comparison purchasing is not permitted.

9. Limitation of Liability

To the fullest extent permitted by law, Vian Diamonds shall not be liable for indirect, incidental, consequential, or punitive damages.

Our maximum liability shall not exceed the purchase price of the product giving rise to the claim.

10. Disclaimer

The Site and its contents are provided “as is” and “as available.”

We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

11. Arbitration & Governing Law

These Terms are governed by the laws of the State of Florida.

Any dispute shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under the Federal Arbitration Act.

Arbitration shall proceed on an individual basis. Class actions and jury trials are expressly waived.

12. Ethical Commitment

Vian Diamonds is committed to responsible sourcing practices, adherence to the Kimberley Process, and compliance with applicable human rights and anti-modern slavery regulations.

13. Privacy

Your use of the Site is also governed by our Privacy Policy.

14. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force.
